Contract
By South Carolina law, everything sold at auction must have a contract. A contract can be negotiated with ODAC to fit your individual needs. The contract will be returned to the auction staff. This contract gives ODAC the sole right to sell the listed merchandise until the specified auction date.
Transportation
There is a possibility that ODAC can transport your merchandise to the auction site if you do not have the means to do so, or are not able to do so. There will be ODAC employees to assist you in unloading, tagging, and placement of your merchandise at the sale site.
Titles
All merchandise requiring a title (vehicles, trailers, and equipment) must be given to ODAC at time of check-in at the sale site. No exceptions. Titles must be clear of any discrepancies, or clearly listed. Titles with liens must be accompanied by the lending institution’s name, address, phone number, and contact person. An item can be sold without a title, but must be clearly marked “no title” or NT.
Price Protection
ODAC does not provide price protection during any auction. A person must be present to represent their merchandise. Any merchandise not represented will be sold to the highest bidder.
Post Auction
At the conclusion of the auction, you will receive an itemized list with details of merchandise and the price it was sold for. Your itemized list should correspond with your contract. Checks will be mailed to the address on the original contract 3-10 business days after the sale
For Buyers
Registration Requirements
- A valid driver’s license, passport, or government ID.
- Bank letter of guarantee (expenditures over $500.00 dollars)
- Tax exempt forms
Bidding
Once registration is complete, you will receive a buyer’s number and can participate in that auction. ODAC does not give permanent numbers. You must register at each auction. All items are sold “as is, where is”. ODAC is not responsible for mercantibility, hours, mileage, usefulness, or intended purpose. All advertised information was obtained from sources assumed to be correct, but is not guaranteed. All sale date announcements take precedence over any printed material.
Payment
All purchases must be paid in full on the day of the sale. We accept cash, checks, wire transfers, money orders, and most major credit cards.
Titles
Any vehicles, trailers, or equipment that is sold which is accompanied by a title will be mailed 3-10 business days after the auction.
Checkout
Upon full payment of your purchase, you will receive a paid receipt. Items cannot and will not be removed from the auction site until full payment is rendered.
Terms and Conditions
Payment
Everything must be paid in full on the day of the auction, regardless of when it is picked up from the sale site. Full payment will consist of cash, check, wire transfers, money orders, and most major credit cards. Personal checks must be accompanied by a bank letter of credit with ODAC sale date, and purchase amount clearly stated in the bank letter. All checks will be made payable to ODAC.
Sales Tax
All sales are subject to state and local taxes. Sales tax exempt forms will be available for farm and agriculture use upon final payment. Tax exempt customers need to provide a copy of their tax exempt form at registration.
Bidding
In the event of a tie bid, the auctioneer reserves the right to re-open the bidding between those two bidders.
The auctioneer reserves the right to accept bids in any increment he feels is in the best interest to the client of his seller.
The auctioneer reserves the right to reject the bidding of any person whose conduct, actions, or adverse comments he feels is not in the best interest of the seller.
Buyers Premiums range from 3% to 13%.
Guarantees
All sales are “as is, where is” with no guarantees said or implied from the auction block. Buyers are solely responsible for their own inspection and information.
Auction Day
All spectators, buyers, and sellers are at the auction site at their own risk. The auction arena can be dangerous due to moving equipment, sharp objects, heat, and uneven terrain.
ODAC cannot and will not be held responsible for injury to any persons or property at auction sites.
Risk of Loss
We make every effort to “guard” and protect merchandise prior and throughout auctions. The successful bidder is solely responsible for the item he or she has purchased immediately following the winning bid. Therefore, the successful bidder is advised to further guard his items at his own discretion.
Shipping and Transportation
Sellers
Equipment or merchandise should be hauled to the sale site where it will be unloaded, tagged, and placed in the sale line for the upcoming auction. There will be employees to assist the driver in unloading and placement of the merchandise. ODAC employees will not be solely responsible for unloading and placement. Transportation of your equipment or merchandise will be available upon request, however, this service will not be free of charge. Please call for prices or rates.
Any item not sold will be the seller’s responsibility and must be removed from the sale site within a specified time frame.
Buyers
Once equipment or merchandise is purchased, it is the buyer’s responsibility for pick-up and removal within a specified time. Buyer takes immediate responsibility for any purchases at the point of the winning bid. Transportation from the auction site is available upon request at specified rates.
ODAC is not responsible for any merchandise or equipment left at sale site for future pick-up.
Letters of Credit
Need Information for Letter of Credit
Letter has to be on Bank Letterhead
- Customer’s full name as it appears on the check.
- Customer’s physical address.
- Dollar amount the check is good.
- Our Company name (ODAC).
- Auction date and town where the auction is located.
- Account number of the check that will be presented.
- Contact name and phone number of the Banker that can be reached on Saturday.
**Cashier Checks will only be accepted in the exacted amount of the invoice.
**We do not accept travel checks.
